1. Who You're Buying From
Orders placed through Truq are placed with and fulfilled by the independent food truck or mobile vendor (“Vendor”) whose menu you are ordering from. Truq is a technology provider only — we provide the ordering platform; we do not prepare, sell, or fulfill any food or goods.
Refunds, order issues, and questions about quality, safety, or fulfillment are handled by, or through, the Vendor. Contact support@gotruq.com if you need help reaching a Vendor about an order.
2. Text Message Program
If you provide your phone number and check the consent box at checkout, Truq will send you text messages (SMS/MMS) about your order status — for example, confirmation and ready-for-pickup notifications — on behalf of the Vendor you ordered from.
- You may receive up to 3 messages per order placed.
- Consent to receive text messages is not a condition of purchase.
- Message and data rates may apply depending on your mobile carrier and plan.
- Reply STOP to opt out at any time, or reply HELP or contact support@gotruq.com for assistance.
Carriers are not liable for delayed or undelivered messages.
3. Payments
Payments are processed by Stripe, Inc. Truq charges a platform fee, currently 2.0% + $0.27, shown at checkout before you complete your order. The Vendor is the merchant of record for your purchase.
4. Acceptable Use; Disclaimer; Limitation of Liability
You agree to use the Platform only for lawful purposes and not to interfere with its operation or misuse any Vendor's ordering page.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TRUQ IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF ANY VENDOR'S PRODUCTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUQ'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT OF TRUQ'S PLATFORM FEE PAID ON THE ORDER GIVING RISE TO THE CLAIM. TRUQ SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
5. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflicts of law principles.
